Electric generating facilities with rated capacities
of 5 megawatts (MW) or less may be constructed without obtaining a Certificate of
Public Convenience and Necessity (
20VAC5-302-10.
). Commission established rules require that persons desiring to construct a facility
submit a letter to the Director of the Division of Energy Regulation stating the
location, size and fuel type of the facility, and comply with all other requirements
of federal, state and local law.
The Commission’s Order of December 23, 2008,
in case No. PUE-2008-00066 directed the Division of Energy Regulation to establish
and maintain on the Commission’s website a listing of all filings made pursuant
to the Virginia Administrative Code,
20VAC5-302-10.
